Unclaimed Property Law

Mr. Palmer does a significant amount of work involving the Unclaimed Property Law and has significant lawsuits pending against California Controller Steve Westly involving the mishandling of public and private funds. See, for example, Mr. Palmer's published decisions in Harris, et. al. v. Westly (2004) 116 Cal. App. 4th 214. (Held: Failure to publish notice under Unclaimed Property Law did not require controller to return current value of stock to an owner of unclaimed shares. Notice was not a condition precedent to statutory obligation to liquidate escheated personal property.) Also see Fong v. Westly (2004) 117 Cal. App. 4th 841. (Held: Because an action filed by owners of escheated stock arose primarily from a sale by the California Controller, the Controller was immune from suit. Since the proceeds of the sale were recovered, the owners had obtained the full amount allowed by law.)
